10.03.010 Dogs to Be Seized and Impounded; Notification of Owner; Unclaimed Dogs

(a) No dog without a current registration tag, no dog of a fierce, dangerous or vicious nature, no female dog in heat, and no dog which becomes a nuisance to others when trespassing upon streets, public places or premises of others shall be permitted to run at large within the Turtle Mountain Jurisdiction.

(b) The police or any persons specifically appointed for such purposes are hereby authorized to seize and impound such dogs in a tribally designated and maintained impoundment, and the owner, if known, shall be promptly notified. Unless a dog is redeemed by its owner within three (3) days after such notice, or, if the owner is unknown, within three (3) days after its impoundment, it shall be considered unclaimed.

(c) If a dog is surrendered to Turtle Mountain Animal Rescue (TMAR), Turtle Mountain Animal Rescue is authorized to accept the surrendered stray dog(s) from the tribal land and hold such stray dog for five days.

(d) If the surrendered stray was on premises for more than two days. Turtle Mountain Animal Rescue will hold for an additional three days before finding appropriate placement.

(e) If the animal was surrendered on the day of arrival, Turtle Mountain Animal Rescue will hold the dog for five days before the animal is considered unclaimed.

(f) "Unclaimed dog" shall mean no responsible individual or family presented themselves to TMAR or the Tribal Animal Control as the register owner.
