12.03.040 Cure by Seller of Improper Tender or Delivery; Replacement

(a) Where the buyer rejects any tender or delivery by the seller because the goods or the manner of tender or delivery is not in conformance with the contract, and the time for performance of the seller's duties under the contract has not yet expired, the seller may, within a reasonable time, notify the buyer of his intention to cure the defect, and the seller then may, within the contract time, make a conforming delivery.

(b) Where the buyer rejects a non-conforming tender, which the seller had reasonable grounds to believe would be acceptable, the seller may, if he notifies the buyer within a reasonable time, have a further reasonable time to substitute a conforming tender.
