2.08.040 Depositions

Depositions may be taken from any party or witness and may be oral or written.

(a) Oral depositions may be taken before any person qualified to take oaths in the jurisdiction in which the witness or party is located. Oral depositions must be recorded and signed by the witness or party. Notice must be given to all parties to the action of the time and place the deposition is to be taken so that such parties may cross-examine the deponent.

(b) A written deposition shall consist of written questions and answers. It shall be signed by the person giving the deposition in the presence of any person qualified to take oaths in the jurisdiction in which the witness or party is located. Such persons shall attest to the deposition. Answers to deposition questions to which objections are made shall be deferred until the objection is ruled upon by the Court.
