24.47.020 Waiver and Variance of Rights and Duties

Except as otherwise provided in Section 24.47.220, to the extent that they give rights to a debtor or obligor and impose duties on a secured party, the debtor or obligor may not waive or vary the rules stated in the following listed sections:

(a) Paragraph (C) of subdivision (4) of subsection (b) of Section 24.43.070, which deals with use and operation of the collateral by the secured party;

(b) Section 24.43.100, which deals with requests for an accounting and requests concerning a list of collateral and statement of account;

(c) Section 24.44.020, which deals with perfection and priority of agricultural liens;

(d) Subsection (c) of Section 24.47.070, which deals with collection and enforcement of collateral;

(e) Subsection (a) of Section 24.47.080 and subsection (c) of Section 24.47.140 to the extent that they deal with application or payment of noncash proceeds of collection, enforcement, or disposition;

(f) Subsection (a) of Section 24.47.080 and subsection (d) of Section 24.47.140 to the extent that they require accounting for or payment of surplus proceeds of collateral;

(g) Section 24.47.090 to the extent that it imposes upon a secured party that takes possession of collateral without judicial process the duty to do so without breach of the peace;

(h) Subsection (b) of Section 24.47.100, Section 24.47.110, and Section 24.47.130, which deal with disposition of collateral;

(i) Subsection (f) of Section 24.47.140, which deals with calculation of a deficiency or surplus when a disposition is made to the secured party, a person related to the secured party, or a secondary obligor;

(j) Section 24.47.180 through Section 24.47.200, which deal with acceptance of collateral in satisfaction of obligation;

(k) Section 24.47.210, which deals with redemption of collateral;

(l) Section 24.47.220, which deals with permissible waivers; and

(m) Section 24.47.230 and Section 24.47.240, which deal with the secured party's liability for failure to comply with Chapters 24.42 through 24.48.
