24.48.010 Savings Clause

(a) Except as otherwise provided in this part, Chapters 24.42 through 24.48 apply to a transaction or lien within its scope, even if the transaction or lien was entered into or created before [the effective date of Chapters 24.42 through 24.48].

(b) Except as otherwise provided in subsection (c) and Section 24.48.020 through Section 24.48.080:

(1) Transactions and liens that were not governed by the former chapter 24 and were validly entered in to or created before [the effective date of Chapters 24.42 through 24.48] and would be subject to Chapters 24.42 through 24.48 if they had been entered into or created after the Tribe adopted this amended this title, and the rights, duties, and interests flowing from those transactions and liens remain valid after [the effective date of Chapters 24.42 through 24.48]; and

(2) The transactions and liens may be terminated, completed, consummated, and enforced as required or permitted by Chapters 24.42 through 24.48 or by the law that otherwise would apply if Chapters 24.42 through 24.48 had not taken effect.

(c) Chapters 24.42 through 24.48 do not affect an action, case, or proceeding commenced before [the effective date of Chapters 24.42 through 24.48].
