26.14.080 Fraud

(a) Any person who shall by misrepresentation or deceit, or by false interpretation, obtain any money or other property shall be guilty of fraud. The following shall be classified to the amounts:

(1) Less than $100.00 shall be guilty of a Class [2] two offense.

(2) over $100.00 but less than a $1,000.00 shall be guilty of a Class [3] three offense.

(3) greater than $1,000.00 shall be guilty of a Class [4] four offense.

(b) It shall be unlawful to use a credit, debit or bank card for the purpose of obtaining money, property or services with the fraudulent knowledge that use of a credit, debit or bank card or without lawful authority.

(1) The card was stolen;

(2) The card has been revoked or canceled; or

(3) The card has been found; or

(4) For any other reason his/her use of the credit, debit or bank card is unauthorized by either the issuer or the person to whom the card has been issued.

(c) Whoever, having devised or intending to devise any scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses, representations, or promises, or to sell, dispose of, loan, exchange, alter, give away, distribute, supply, or furnish or procure for unlawful use any counterfeit or spurious coin, obligation, security, or other article, or anything represented to be or intimated or held out to be such counterfeit or spurious article, for the purpose of executing such scheme or artifice or attempting so to do obtains the property of another by such scheme or artifice is guilty of fraud punishable by shall be guilty of a Class 3 offense.

(d) Whoever by use of his or her position of authority, employment with the Turtle Mountain Band of Chippewa Indians or one of its entities wholly or partially owned by Turtle Mountain Band of Chippewa Indians having devised or intending to devise any scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses, representations, or promises, or to sell, dispose of, loan, exchange, alter, give away, distribute, supply, or furnish or procure for unlawful use any counterfeit or spurious coin, obligation, security, or other article, or anything represented to be or intimated or held out to be such counterfeit or spurious article, for the purpose of executing such scheme or artifice or attempting so to do obtains the property of Turtle Mountain Band of Chippewa Indians or one of its entities wholly or partially owned by Turtle Mountain Band of Chippewa Indians by such scheme or artifice is guilty of fraud punishable by shall be guilty of a Class 4 offense.
