26.20.050 Arson

A person commits the offense of arson, and shall be guilty of a Class 4 offense if such person:

(a) Starts or maintains, or causes to be started a fire or an explosion with intent to destroy an entire or any part of a building, inhabited structure of another, or a vital public facility,

(b) Starts or maintains a fire or causes to be set a fire or an explosion with intent to destroy or damage his own real or personal property for the purpose of collecting insurance for the loss.

(c) Willfully, intentionally, recklessly, or maliciously and without authority starts or causes to be started, a forest fire or wildfire that destroys any crops, hay or hay bales, fences, or timber, injures or kills any livestock, damages or destroys any inhabited structures, equipment, farm structures or residences.

(d) Willfully, intentionally, recklessly, or maliciously, and without authority re-ignites or rekindles any fire that was extinguished, or is being extinguished, by the Fire Department or Bureau of Indian Affairs - Fire Management.

(e) Starts or causes to be started, any fire for the purpose(s) of gaining employment or compensation.

(f) Starts or causes to be started, any fire, for the purpose of covering up or destroying evidence of another crime.

(g) Willfully, intentionally, recklessly, or maliciously starts or causes to be started any fire, or causes an explosion that places another person in danger of death or bodily injury, including Forestry personnel, structural fire/ rescue and law enforcement personnel at the scene.
