3.03.080 Declarations Against Interest

(a) A declaration is against the interest of a declarant if the judge finds that the fact asserted in the declaration was at the time of the declaration so far contrary to the declarants pecuniary or proprietary interest, or so far subjected him to civil or criminal liability, created such a risk of making him an object of hatred, ridicule or social disapproval in the community that a reasonable man in his position would not have the declaration unless he believed it to be true.

(b) A declaration against interest is not admissible unless the declarant is not available as a witness.
