36.03.050 Elder Exploitation Stealing Assets. Penalty -

(a) Any person who willfully acts or uses an Elder or their resources for another person's profit, advantage, gain or for monetary, or personal benefit without legal entitlement including, but not limited to, forging an Elder's signature to cash a check or take money, using their ATM card to take money, or taking any cash on hand without the Elders consent or knowledge will be guilty of Elder Exploitation Stealing Assets and may be punished according to this code by amount stolen:

(b) Penalty.

(1) Less than $100.00 shall be imprisoned for a term of not less than fifteen (15) days, not to exceed ninety (90) days and shall be fined an amount not less than two hundred fifty dollars ($250.00), not to exceed five hundred dollars ($500.00). Complete Mandatory Requirements (1-4) in Section 36.04.040.

(2) More than $100.00 shall be imprisoned for a term of not less than thirty (30) days, not to exceed one hundred eighty (180) days and shall be fined an amount not less than five hundred dollars ($500.00), not to exceed one thousand dollars ($1000.00). Complete Mandatory Requirements (1-4) in Section 36.04.040.

(3) More than $1000.00 shall be imprisoned for a term of not less than forty-five (45) days, not to exceed three hundred sixty-five (365) days and shall be fined an amount not less than one thousand dollars ($1000.00), not to exceed two thousand five hundred dollars ($2500.00). Complete Mandatory Requirements (1-4) in Section 36.04.040.

(4) Per the second offense of Elder Exploitation Stealing Assets, the sentence shall double.

(5) Per the third offense of Elder Exploitation Stealing Assets, the sentence shall triple.
