36.04.050 Civil Penalties

(a) A person convicted of Elder Abuse may be held liable for civil penalty.

(b) Restitution shall be ordered when deemed appropriate by the Turtle Mountain Tribal Court.

(c) Any person who is convicted of financial exploitation of an Elder shall be ordered by the Turtle Mountain Tribal Court to reimburse the Elder in full as a consequence of any plea bargain, guilty plea, finding of guilty by a judge or jury or nolo contendere pleas. If the person has exploited resources other than money from the Elder, then the court shall order the offender to return the resources immediately or to sign the necessary documents returning the resources to the Elder or to reimburse the monetary value of the resources exploited.

(d) Upon conviction for the crime of Elder Abuse, the Turtle Mountain Tribal Court may order the removal of any weapons from the defendant's possession for a period of five to ten (5-10) years.
