38.02.270 Failure to Drive on Right Side of Roadway

Upon all highways of sufficient width, the Indian driver of a vehicle shall drive upon the right half of the highway, except:

(a) when overtaking and passing another vehicle proceeding in the same direction,

(b) when the right half of the roadway is closed to traffic while under construction or repair or sign posted for one-way traffic or other conditions.

(1) No Indian shall at any time drive a vehicle to the left side of the roadway

(2) when approaching the crest of a grade or upon a curve in the distance as to create a hazard in the event another vehicle might approach from the opposite direction,

(3) when approaching within one hundred (100) feet of or traversing any intersection or railroad grade crossing, or

(4) when the view is obstructed upon approaching within one hundred

(100) feet of any bridge, viaduct, or tunnel.
