51.03.030 General Powers of the Hemp Regulatory Commission

(a) The Hemp Regulatory Commission shall have the following powers to regulate hemp production and processing within the Tribe's jurisdiction:

(1) Promulgate implementing regulations for this title as is necessary and appropriate;

(2) Set the policies and procedures and establish and collect license and testing fees for all hemp production and processing;

(3) Modify, adapt, or amend such policies and procedures as necessary, to keep them in line with best industry practices and procedures as well as applicable Tribal, state, or federal law;

(4) Review applications and issue licenses for hemp cultivation and processing;

(5) Conduct (or cause to be conducted) the sampling, testing, and inspection of industrial hemp fields and industrial hemp handling facilities, including places where hemp is grown, stored, processed, or handled;

(6) Conduct (or cause to be conducted) the inspection of hemp processing facilities to ensure compliance with all applicable construction, workplace safety, or food handling laws, regulations, or requirements;

(7) Conduct (or cause to be conducted) record audits of industrial hemp Licensees;

(8) Produce and maintain all forms for application, registration, reporting, or other activity required under this title, Commission policy, or regulations promulgated under this title;

(9) Set administrative procedures for and impose appropriate corrective action for violations of this title; and

(10) Advise the Chairman and Tribal Council and make recommendations pertaining to hemp production or processing on the Reservation and annual budgets required to accomplish the purposes of this title.
