51.07.010 Inspection

(a) The Commission and, when applicable, the Health Authority shall have the authority to conduct random investigations of a Licensee's hemp processing facility to verify compliance with all requirements of this title, Commission or Health Authority-issued regulations and guidelines and tribal law.

(b) The Commission shall conduct annual inspections of a Licensee's hemp processing facility to verify all hemp-processing activities are conducted in compliance with this code and Commission-issued regulations and guidelines.

(c) The Tribal Health Authority, when applicable, shall have the authority to conduct inspections, random or otherwise, of a Licensee's hemp processing facility to ensure the facility and hemp processing activities are in compliance with tribal law and Health-Authority established health standards, regulations and guidelines.

(d) The Commission may randomly sample all hemp and hemp material at a hemp processing facility, at the Commission's discretion. If the Commission samples any hemp or hemp material, the Licensee shall set aside all sampled hemp and hemp material until the Licensee receives notice from the Commission of the hemp and hemp material's compliance with this Code. If the material is found to have a THC level greater than .3%, then the Licensee shall dispose of all non-compliant hemp and hemp material in the manner described in Section 51.08.060 of this Code.

(e) All inspections and random samplings may be conducted at any time during regular business hours.
