52.04.050 Powers and Duties of the Health Officer

(a) The Health Officer shall, upon the approval of Tribal Council, have the authority to appoint and manage a reasonable staff as required to carry out the powers and duties of the Health Officer.

(b) The Health Officer shall have the following powers and duties:

(1) Conduct, promote, and finance, in full or in part, with the approval of the Tribal Council, studies, investigations, programs and research, independently or in cooperation with universities, colleges, scientific organizations, and public or private agencies;

(2) Order the enforcement of such quarantine and isolation orders as necessary for the protection of public health;

(3) Recommend, as necessary, to Tribal Council appropriate responses to public health emergencies, including, but not limited to:

(A) The closure of businesses or appropriate limits to the operations of businesses;

(B) Social distancing;

(C) Shelter in place;

(D) Removal or exclusion of non-Indian individuals from the Tribe's jurisdiction;

(4) Recommend to Tribal Council policies and regulations governing the control of communicable disease within the Tribe's jurisdiction;

(5) Communicate with tribal government authorities and businesses to coordinate responses to public health emergencies; and

(6) Communicate and coordinate responses to public health emergencies and issues with State, federal, or Tribal Health Officers and State Public Health Units.
