1.21.010 Definitions

As used in this chapter, unless the context clearly requires a different meaning.

(a) "Vessel" means every description of watercraft, other than a seaplane on the water, used or capable of being used as a means of transportation on water.

(b) "Motorboat" means any vessel propelled by machinery, whether or not such machinery is the principal source of propulsion, but shall not include a vessel which has a valid marine document issued by the Bureau of Customs of the United States Government or any federal agency successor thereto.

(c) "Owner" means an Indian, other than a lien holder, having the property in or title to a motorboat. The term includes an Indian entitled to the use or possession of a motorboat subject to an interest in another Indian, reserved or created by agreement and securing payment or performance of an obligation, but the term excludes an Indian lessee under a lease not intended as security.

(d) "Waters of the Turtle Mountain Jurisdiction" means any waters within the jurisdiction of the Turtle Mountain Tribal Court.

(e) "Indian Person" means Indian as defined by Section 1.03.010(f) of this Code.

(f) "Operate" means to navigate or otherwise use a motorboat or a vessel.

(g) "Department" means the State Game and Fish Department of the State of North Dakota.
