2.09.010 Jury Trial; Right Time for Request

(a) The right to trial by jury shall exist in all cases where the plaintiff's claim exceeds two hundred dollars ($200). In all other cases the use of a jury shall be at the discretion of the Court.

(b) Time for request of jury trial. In cases in which a jury may be had, the request for a jury must be made in writing to the clerk and may be made by either party at any time after commencement of the action, but not later than five (5) days after the filing of the last pleading. The request for a jury trial by either party must be accompanied by a cash or surety bond in the amount of one hundred dollars ($100) to cover the costs or the jury trial.

(c) The failure of a party to demand a jury, as required by Subsection (b) of this section, constitutes a waiver by him of a trial by jury.
