38.01.460 Seat Belt Safety and Child Restraint

(a) The use of seat belts in passenger vehicles shall be a requirement and all vehicle occupants must have a safety belt properly fastened about his/her body at all times when the vehicle is in motion.

(b) Violators of this section are subject to a civil assessment fee of $25 first offense; $35 second offense, and $50 third offense.

(c) Children under the age of three (3) must be secured in a child restraint that meets safety standards adopted by the United States Department of Transportation and be used according to manufacturers instructions. While the motor vehicle is moving, each child of three (3) through ten (10) years of age must be in a child restraint system or buckled seatbelt. Violation is punishable by a fine not to exceed ($20) dollars.
