39.01.060 Exclusion, Removal and Other Civil Penalties

(a) A member of the Tribe or non-member charged in Tribe, State, or Federal Court or upon a probable cause affidavit of one or more of the above offenses shall be subject to civil exclusion and removal as provided herein from Indian Country under the territory and jurisdiction of the Turtle Mountain Band of Chippewa Indians for the following periods of time:

(1) Indians Dealing, Transporting (or assisting in the transport of) and/or Selling Drugs of Any Kind:

(A) First Offense (Tribal or Federal) – warning

(B) Second Offense (Tribal or Federal) – three-year exclusion

(C) Third or further Offense (Tribal or Federal) – lifetime exclusion

(2) Non-Indians Dealing, Transporting (or assisting in the transport of) and/or Selling Drugs of Any Kind:

(A) First Offense (Tribal or Federal) –three-year exclusion.

(B) Second or further Offense (Tribal or Federal) – lifetime exclusion.

(3) Other Non-Drug-Related Grounds for Removal of Non-Indians Only:

(A) First Offense –Six Month Exclusion

(B) Second Offense - One Year Exclusion

(C) Third and subsequent Offenses – Five Year Exclusion for each offense

(4) Indians and/or Non-Indians Convicted of Repeated Sex Crimes:

(A) First Offense –One Year Exclusion

(B) Second and subsequent Offense – One Year Exclusion to lifetime exclusion

(5) Non-Indians who are habitually criminal and disturb the peace and dignity of the territory and jurisdiction of the Tribe.

(A) First Offense (Tribal or Federal) –three-year exclusion.

(B) Second or further Offense (Tribal or Federal) – lifetime exclusion.
